STRICKLAND MFG LIMITED TERMS AND CONDITIONS OF WARRANTY AGREEMENT

In all conditions subsequent, the terms “we” and “us” denote Strickland MFG Limited and its operatives, internally or externally contracted.

The purchase of this hitch, the subsequent signature of this card, the return of this card, either via post, or as a scanned PDF emailed to the Strickland service email address and finally, the confirmation of receipt from us activates the Warranty Agreement. This email address can be located at the bottom of the reverse side of this card.

This Warranty Agreement is entered into between STRICKLAND MFG Ltd, a company organized and existing under the laws of England and Wales of the United Kingdom, with its principal place of business at Strickland MFG, Enterprise Way, Evesham, Worcestershire, WR11 1AA and the customer for whom we have sold to. If you have purchased this from a company that is not us, you are not covered by us, unless your supplier has a secondary coverage agreement with us. Please contact them for further information in this instance.

The responsibilities that we undertake in respect of such goods and services are that, free of charge, we will repair or (at our sole discretion) replace [1] any goods sold or supplied by us which are either defective as a result of faulty materials or workmanship or are otherwise not of satisfactory quality; and [2] any goods repaired by us which are defective as a result of our faulty repair work.

Strickland MFG warrants that upon delivery, and unless agreed otherwise, the product(s) will be free from defects in material and workmanship under normal use, in conjunction with and adherence to the fitting procedures (if applicable), user operation instructions, maintenance requirements and correct procedural safety monitoring. Our applicable warranty coverage term begins from the date noted on this card at the point of receipt and acknowledgement of receipt of this card (signed and dated). A window of cover will be offered from the date of shipment up to [a] receipt and of acknowledgement of signed card or [b] a period of 90 days (whichever occurs first). This remains at the sole discretion of us and we maintain the right to question any date that falls outside of the above 90-day window. The coverage is, for the main body, frame and moving jaw: [1] Hitches 5T and above are covered for 36 months, or 6,000 hours (whichever occurs first). [2] Hitches up to 3T are covered for 12 months, or 2,000 hours. A coverage of 12 months is offered on the hydraulic ram. Labour charges are also covered for this period. Pipework must be signed off at point of fitment. If it is confirmed at this time that there are no leaks or faults, no further cover will be offered.

This warranty is limited to repair or replacement, at the discretion of us and we maintain the right to void any warranty that is diagnosed to have not adhered to one or multiple of the requirements dictated above and noted in our operator’s manual supplied to the customer with all warranty covered product(s). Please ensure that all operators have fully read and understood the operator’s manual.

This warranty does not cover damage or defects resulting from: [1] incorrect use of the product(s) in accordance to the operator’s manual. [2] abuse of the product(s). [3] neglect of the product(s). [4] non-agreed alterations of the product(s) or subsequent attachments. [5] use of non-Strickland parts which a diagnosed to be detrimental to the products use. All correct usage and maintenance requirements can be found in the operator’s manual. The operator’s manual needs to be fully read and understood before any first usage, either that of a new hitch, or that of a new operator.

To make a warranty claim, the Customer must: [1] email the service department at the service email noted within the warranty period. [2] Provide proof of purchase. If the product(s) was supplied to you by us, this can be located by providing your service rep with the hitch serial number. If the product(s) was not supplied to you by us, then you will need to raise your claim through your supplier. If they have a secondary coverage agreement with us, it can then be raised with us. [3] provide a detailed description of the alleged defect or issue. [4] agree at this point with us the agreed steps for issue resolution. This can consist of [a] an engineer visit being processed by us to an agreed timeframe. or [b] the repair being carried out by you, the customer to the charge and time caps dictated in the warranty & service level agreement card supplied with all warranty covered product(s). In all cases, warranty is not agreed until the warrantable parts have been returned to us at the address noted above for the attention of the service team, and a full inspection has been carried out by service engineers. We reserve the right to void a warranty claim up to the completion of inspection and subsequent diagnosis, unless agreed otherwise in writing.

Each warranty coverage is unique and will be investigated and actioned as such. Any implication of results of prior claims will not be taken into consideration. Strickland disclaims and excludes all other conditions, warranties or representations of all kinds, express or implied, statutory or otherwise, including all implied warranties and conditions relating to merchantability, satisfactory quality and fitness for particular purpose.

We will assess the warranty claim and, if determined that defects are covered under this agreement, will agree to the cover of parts and/or labour as required. If it is determined not to be covered, we will issue the customer with a composite breakdown of findings and subsequently invoice the customer for claimed work.

To the fullest extent permitted by law, the liability of Strickland MFG under this warranty is limited to the repair or replacement of the defective product(s) and shall not exceed the original purchase price of the product(s). In no event shall the Company be liable for any indirect, consequential, incidental, or special damages arising out of or in connection with the use or performance of the product(s).

This Agreement shall be governed by and construed in accordance with the laws of England and Wales of the United Kingdom. Any disputes arising under or in connection with this agreement shall be subject to the exclusive jurisdiction of the courts.
